Virginia Delegate Kathy Tran (D) responded to criticism of her bill that would eliminate restrictions on abortion in Virginia and would permit abortions to be performed right up to the moment of birth, saying that her bill does “nothing to change” abortion in the latter stages of pregnancy.
“I want to be very clear about what is currently allowed by Virginia law. Right now women are allowed to access an abortion in the later stages of pregnancy under certain conditions with the approval of medical doctors,” Tran said in a video posted on her Twitter account.
“I’ve done nothing to change that. What I have done is try to make sure that women are able to make these decisions and access these services in a timely manner,” Tran added.
Tran’s Bill, HB 2491, was tabled by a subcommittee in the Virginia Legislature in a 5-3 vote on Monday. According to the Summary of HB 2491, the bill would eliminate many restrictions on abortion in Virginia.
According to the summary, the bill:

“Eliminates the requirement that an abortion in the second trimester of pregnancy and prior to the third trimester be performed in a hospital.”

“Eliminates all the procedures and processes, including the performance of an ultrasound, required to effect a woman’s informed written consent to the performance of an abortion; however, the bill does not change the requirement that a woman’s informed written consent be first obtained.”

“Eliminates the requirement that two other physicians certify that a third trimester abortion is necessary to prevent the woman’s death or impairment of her mental or physical health, as well as the need to find that any such impairment to the woman’s health would be substantial and irremediable.”

“Removes language classifying facilities that perform five or more first-trimester abortions per month as hospitals for the purpose of complying with regulations establishing minimum standards for hospitals.”

“Hi, I’m Kathy Tran and I represent the 42nd District of the Virginia House of Delegates. I know women in my family, women in my district, and women across Virginia who had to make the very personal decision as to whether or not they are going to have an abortion.
“That’s why I introduced a bill to repeal the medically unnecessary and unduly burdensome barriers that Virginia women face when they’re accessing this health care service in consultation with their doctor.
“I presented my bill this week and I was really surprised by the line of questioning that I got. This bill had been introduced in the General Assembly in previous years and, in fact, this session, was also introduced in the State Senate.
“I want to be very clear about what is currently allowed in Virginia law. Right now women are allowed to access an abortion in the later stages of pregnancy under certain conditions with the approval of medical doctors. I’ve done nothing to change that. What I have done is try to make sure that women are able to make these decisions and access these services in a timely manner.
“Since the bill hearing, I’ve heard from many women in my district and across Virginia who support my efforts to make sure that politicians don’t get between a woman and her healthcare decisions. I appreciate their support and I will continue to stand with the women in Virginia. Thank you.”
