Washington, DCThe legal status of abortion across the states is shaped not only by the Dobbs decision but also by a range of additional factors. These include recent state constitutional rulings interpreting abortion as a protected right; the passage of laws aimed at safeguarding unborn life; ongoing litigation challenging or defending those laws; and the implementation of so-called “shield laws.” These are laws designed to protect abortion providers who reside in abortion-friendly states who prescribe abortions pills in states where abortion is almost entirely proscribed.

In the three years since Dobbs, these developments have significantly sculpted the abortion landscape. As a result, the 2025 state legislative sessions have seen a significant amount of activity on both sides of the issue. States either reinforced life-saving protections for unborn life or expanded lethal access to abortion on demand through new statutes and constitutional amendments. ….
